These are the general sales conditions of brioche. Amsterdam
The general terms and conditions of sale apply to all orders placed with and payments made to French Fika B.V. owner of the bakery brioche. Amsterdam . Deviations from these terms and conditions can only be made in advance, in writing and explicitly on points, with the other provisions remaining in full force.
By placing an order, the customer of brioche. Amsterdam to accept these conditions.
Declaration of own use
Products, purchased from brioche. Amsterdam, are intended for the customer’s personal use. Under no circumstances may products be resold to third parties, unless otherwise agreed. Neither the brand name nor the logo of brioche. Coffee & Bakery.
Products are made by hand. The shape, color, texture, taste and weight of a product may differ from the description and the photo shown with the product. In addition, with bread, differences in the regions of origin and the harvest quality of the grain can cause fluctuations in texture and taste. This is not a shortcoming of the product, but the result of manual production without the addition of bread improver.
All applicable prices always include VAT. Brioche (French Kika BV) accepts no liability for typesetting or printing errors. reserves the right to immediately pass on changes in cost prices, labor costs or (legal) regulations.
By placing an order in the shop via the webshop or via email, the agreement is a fact. Brioche reserves the right to refuse orders without giving reasons, or to attach conditions to them, such as requiring a deposit (does not apply to the webshop).
At Brioche. the customer fulfils the obligation arising from the agreement mentioned under “Orders” by payment via iDeal or credit card via the webshop, or by PIN/cash payment in our shop in the case of an e-mail or on-site order, unless otherwise discussed.
The customer is obliged to inspect the goods immediately upon receipt. Any defects and defects visible upon receipt must be reported to Brioche within one day of receipt, under penalty of forfeiture of all rights arising therefrom. Complaints should be submitted to Brioche by e-mail ([email protected]), specifying the nature of the complaints in respect of the goods delivered, and preferably with the addition of a photo of the product concerned.
Brioche has the choice of replacing the product in question with a new product against reason or refunding the invoice value thereof.
Transfer of risk and ownership
The risk of the delivered goods passes from Brioche to the customer as soon as the transfer of the products to the customer has taken place.
Brioche (French Kika BV) is not liable for damages, which are not attributable to intent or gross negligence of Brioche (French Kika BV) or which have arisen due to circumstances not at the risk of Brioche (French Kika BV).
Brioche (French Kika BV) bears no responsibility for information, photos and other forms of information materials to the extent published under the responsibility of third parties. For actions and/or shortcomings of third parties, Brioche (French Kika BV) shall bear. Brioche (French Kika BV) is not liable for misunderstandings, delays or improper transmission of orders and notifications resulting from the use of the Internet or any other means of communication in the traffic between the client and Brioche (French Kika BV), unless and insofar as there may be intent or gross negligence on the part of Brioche (French Kika BV). Liability for damages against which the customer is already insured is excluded by Brioche (French Kika BV) at all times.
In the event of force majeure, Brioche (French Kika BV) has the right, at its own discretion, to suspend the execution of any order, or to dissolve it without judicial intervention, by notifying the customer in writing or by telephone and without Brioche (French Kika BV) being obliged to pay any compensation for damages, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness. Force majeure means any shortcoming which cannot be attributed to Brioche (French Kika BV), because it is not due to its fault and is not for its account by virtue of the law, legal act or generally accepted views.
All contacts and transactions with Brioche (French Kika BV) are made subject to all rights and claims of Brioche (French Kika BV). No part of editions or publications of Brioche (French Kika BV) may be reproduced, stored in digital form, or made public, in any form whatsoever, without the prior written consent of Brioche (French Kika BV)
All legal relations between Brioche (French Kika BV) and its customers are governed by Dutch law. Disputes between the parties will be exclusively submitted to the competent court in the Netherlands for that purpose.
